LADR Privacy Notice + Terms of Use

This notice discloses the terms of use and privacy practices for Lawler ADR Services, LLC (LADR) and our website, www.lawleradr.com. This privacy notice applies solely to information collected by this website, except where stated otherwise.

Information Collection, Use, and Sharing

LADR has access to, and collects, personal information that you voluntarily provide to us, including information provided when contacting us about availability, scheduling a mediation or other service, by other direct contact from you, by information (such as contact information) that has been provided to fellow members of professional associations with which Ms. Lawler is involved, and/or contact information placed on your website or on social media and made available to the public.

When you contact LADR or Ms. Lawler to inquire about or arrange for a mediation or other service - whether by email, phone or submission in response to Ms. Lawler’s online calendar - you will generally be asked to provide contact information for yourself as well as contact information for the attorneys representing parties in the matter to be mediated, the names of the parties to the dispute and other involved persons, the name of the case and any court case number if the matter is in suit. Contact information may include names, firm or company names, addresses, telephone numbers, email addresses and similar information. Ms. Lawler also receives mediation assignments from the United States District Court and arbitration assignments from the American Arbitration Association, which includes contact information for counsel (and for a party if unrepresented by counsel), the names of the involved parties, and a case name and number if in suit. Other information may also be provided. We maintain this information indefinitely, even after the mediation or arbitration has been concluded, for historical record keeping purposes, including so that we may run conflict checks when being retained to handle new matters.

Ms. Lawler’s on-line calendar is provided through her membership in the National Academy of Distinguished Neutrals (NADN - nadn.org) and the information input into the calendar is maintained by NADN in a database for use in Ms. Lawler’s ADR practice. NADN sends a monthly email to those persons in the database re Ms. Lawler’s upcoming availability, as well as other occasional emails. Ms. Lawler utilizes the services of Case Manager Services, Inc. to serve as the case manager for her ADR practice. Information about each inquiry and/or scheduled ADR service, including contact information for the attorneys, names of parties, case names and case numbers, is also maintained in an AirTable database for the use of Ms. Lawler.

Ms. Lawler’s occasional Newsletter sent via email is created in Squarespace and issued to a mailing list of names and email addresses maintained on Squarespace. Each Newsletter provides the recipient with the option to “Unsubscribe” from the newsletter by clicking on a button, which will remove that person’s name and email address from the mailing list.

LADR uses various Microsoft programs to maintain our contacts and calendars, handle our email, and create and store documents. We also use other software and services to maintain our records and to provide mediation and other related ADR services, including companies such as Wufoo (a Survey Monkey company), Zapier, Squarespace, Zoom, Adobe, LinkedIn, LawPay and Intuit. Privacy policies of these companies are available on their websites.

We use your information to respond to you regarding the reason you contacted us, to schedule matters for mediation, arbitration or other services, to communicate in connection with services to be provided by us, to run conflict checks, and to otherwise provide ADR services and maintain appropriate business records regarding those services. We also use the contact information for marketing purposes and/or to provide you with legal updates or other information in the future that we deem may be of interest to you, either directly or through Ms. Lawler’s occasional Newsletter.

LADR may disclose any such information to the extent that it is required by law. We do not sell information to anyone and only share information as described above.

Your Access to and Control Over Information

If you do not wish LADR to use your information in accordance with our policy, please do not submit personal information to LADR or to Ms. Lawler. You may always call or email to schedule a mediation rather than using the online calendar. You may opt out of any future contacts from LADR at any time. You may also request us to:

• Inform you about the categories of personal information we collect or disclose about you; the categories of sources of such information; the business or commercial purpose for collecting your personal information; and the categories of third parties with whom we share/disclose your personal information.

• Provide access to and/or a copy of certain personal information we hold about you.

• Change, correct, or delete personal information we have about you.

• Express any concern you have about our use of your data.

Cookies 

We use “cookies” on this site. A cookie is a piece of data stored on a site visitor’s hard drive to help us improve your access to our site and identify repeat visitors to our site, i.e. information about the type of browser you are using; your Internet Protocol ("IP") address; the time, date, and length of your visit; your general geographic location and the referring site. Usage of a cookie is not linked to any personally identifiable information on our site. Cookies will not expire unless you manually delete them or set your browser to reject them. Squarespace analytics tracking has been disabled.

Neither the LADR website, the use of information from the website, nor the submission of information via Ms. Lawler’s online calendar creates any type of attorney-client relationship with Ms. Lawler. Ms. Lawler is a Neutral and cannot and does not act as an attorney for any party to a mediation or arbitration in which she is serving as the mediator or arbitrator.

Notice to Minors

LADR’s website is not directed at and is not intended to be visited by minors. No visitor to our website who is a minor or under the age of 18 should provide any personal information to us. If you are a minor, do not send any type of personal information about yourself to us or through our website.

Changes may be made to this privacy policy from time to time, as may be appropriate.
